CODE OF CRIMINAL PROCEDURE (CRPC)

Section 115 CrPCPower to dispense with personal attendance

Explained in Simple English & Hindi with Real-Life Examples

Original Text

115. Power to dispense with personal attendance.—The Magistrate may, if he sees sufficient cause, dispense with the personal attendance of any person called upon to show cause why he should not be ordered to execute a bond for keeping the peace or for good behaviour and may permit him to appear by a pleader.

In Simple Words (English)

What is this section about?

This section gives the magistrate a flexible power in security proceedings. When a person is called upon to show cause (explain why they should not be ordered to execute a bond), the magistrate can allow that person not to appear in person. Instead, the person can appear through a pleader (in the old law) or an advocate (in the new law). The magistrate can do this if they see "sufficient cause" - meaning there is a good reason for the person not to attend personally.

What is "sufficient cause"?

Sufficient cause can be many things. The person might be sick, living far away, elderly, or have other genuine reasons for not being able to attend court in person. The person might also be in custody in another place. The magistrate has discretion to decide what counts as sufficient cause. The key is that the reason must be genuine and not just an excuse to avoid the proceedings.

Why is this section important?

This section balances the need for the person to participate in the proceedings with the practical difficulties of personal attendance. It recognizes that not everyone can easily come to court. It also allows the person to be represented by a legal professional who can present their case properly. This ensures that the proceedings are fair and accessible. It also reduces the burden on the person and saves court time.

What is the difference between a pleader and an advocate?

In the old CrPC, the term used was "pleader" - a general term for a legal representative. In the new BNSS, the term used is "advocate" - which is the more precise term under the Advocates Act, 1961. The meaning is the same: a qualified legal professional who can represent the person in court. The change reflects the current legal terminology.

What if the person chooses to appear personally?

The section says the magistrate "may" dispense with personal attendance. It does not force the person to appear through an advocate. The person can still choose to appear personally if they prefer. The magistrate can also require personal attendance if they think it is necessary.

What is the difference between old and new law?

The substance is identical. The only difference is the terminology: "pleader" in the old CrPC has been replaced with "advocate" in the new BNSS. The references to related sections have also been updated. The power to dispense with personal attendance remains exactly the same.

Real-Life Example

Example 1: A magistrate in Lucknow issues a show cause notice to Rakesh. Rakesh is 75 years old and unwell. He applies to the magistrate to dispense with his personal attendance and allow him to appear through his advocate. The magistrate sees sufficient cause and permits Rakesh to appear through his advocate. Rakesh's advocate appears and represents his case.

Example 2: A magistrate in Delhi issues a show cause notice to Sanjay. Sanjay is living in another state for work. He applies to appear through his advocate. The magistrate allows this. Sanjay's advocate appears in court and argues that Sanjay should not be required to execute a bond.

Example 3: A magistrate in Mumbai issues a show cause notice to Priya. Priya is in custody in another district. She cannot attend personally. The magistrate dispenses with her personal attendance and permits her advocate to appear on her behalf. The advocate presents Priya's case.

Example 4: A magistrate in Bengaluru issues a show cause notice to Vikas. Vikas applies to appear through his advocate, but the magistrate believes Vikas should attend personally. The magistrate rejects the application because Vikas has no genuine reason. Vikas must attend in person.

Example 5: A magistrate in Patna issues a show cause notice to Gopal. Gopal is seriously ill and in the hospital. He submits a medical certificate. The magistrate accepts this as sufficient cause and permits Gopal to appear through his advocate. Gopal's advocate appears and explains Gopal's position.

Example 6: A magistrate in Jaipur issues a show cause notice to Meena. Meena is an elderly woman who finds it difficult to travel. She applies to appear through her advocate. The magistrate, seeing her age as sufficient cause, allows her advocate to appear. The advocate represents Meena effectively.

Example 7: A magistrate in Chennai issues a show cause notice to Arjun. Arjun wants to appear through his advocate, but the magistrate believes Arjun must attend personally because the case is serious. The magistrate does not dispense with personal attendance. Arjun must appear in court.

Example 8: A magistrate in Hyderabad issues a show cause notice to Sohan. Sohan is living abroad temporarily. He applies to appear through his advocate. The magistrate allows this. Sohan's advocate appears and argues the case. Sohan does not need to return to India for the hearing.
