113. Summons or warrant in case of person not so present.—If such person is not present in Court, the Magistrate shall issue a summons requiring him to appear, or, when such person is in custody, a warrant directing the officer in whose custody he is to bring him before the Court: Provided that whenever it appears to such Magistrate, upon the report of a police officer or upon other information (the substance of which report or information shall be recorded by the Magistrate), that there is reason to fear the commission of a breach of the peace, and that such breach of the peace cannot be prevented otherwise than by the immediate arrest of such person, the Magistrate may at any time issue a warrant for his arrest.

What is this section about?
This section covers what happens when the person against whom a security order is made is not present in court when the order is issued. The magistrate has two options depending on the situation. If the person is not in custody (not in jail), the magistrate will issue a summons - a legal notice requiring the person to appear in court. If the person is already in custody, the magistrate will issue a warrant directing the jail officer to bring the person before the court.
What is the exception for urgent cases?
The proviso (the "provided that" clause) allows the magistrate to take more urgent action. If the magistrate receives a report from a police officer or other information that there is reason to fear a breach of the peace, and that this breach cannot be prevented without immediately arresting the person, the magistrate can issue a warrant for arrest at any time. The magistrate must record the substance of the information they received.
Why is this exception important?
This exception is a safety valve for emergencies. Sometimes waiting to serve a summons and then waiting for the person to appear would be too slow. If there is an immediate threat of violence or disturbance, the magistrate can order the person's arrest right away to prevent the breach of peace. However, the magistrate must have a reasonable basis for this belief and must record the information received.
What is the difference between a summons and a warrant?
A summons is a notice asking the person to come to court on a specific date. It does not involve arrest. A warrant is a command to arrest the person and bring them to court. What is the difference between old and new law?
The substance is identical. The wording is exactly the same. The only difference is the section numbers: the old CrPC Section 113 has become BNSS Section 132. Example 1: A magistrate in Lucknow issues a security order against Rakesh. Rakesh is not present in court. The magistrate issues a summons requiring Rakesh to appear on a specified date. Rakesh receives the summons and appears in court.
Example 2: A magistrate in Delhi issues a security order against Sanjay. Sanjay is already in jail for another offence. The magistrate issues a warrant directing the jail officer to bring Sanjay before the court. Sanjay is produced in court.
Example 3: A magistrate in Mumbai receives a police report that Vikas is about to start a riot. The magistrate believes that only immediate arrest can prevent the breach of peace. Under the proviso, the magistrate issues a warrant for Vikas's arrest immediately. Vikas is arrested and brought before the court.
Example 4: A magistrate in Bengaluru issues a summons to Priya under Section 113. Priya receives the summons but does not appear. The magistrate can then issue a warrant for her arrest. The summons was the first step, and the warrant is the next step if she fails to appear.
Example 5: A magistrate in Patna receives information that Gopal is gathering a mob to cause trouble. The magistrate records the substance of the information and issues a warrant for Gopal's arrest under the proviso. The police arrest Gopal and bring him before the magistrate.
Example 6: A magistrate in Jaipur issues a summons to Meena. Meena is not in custody. The magistrate does not issue a warrant because there is no immediate threat. Meena receives the summons and appears voluntarily.
Example 7: A magistrate in Chennai issues a security order against Arjun. Arjun is not present. The magistrate issues a summons. However, before the summons is served, the magistrate receives a report that Arjun is about to flee. The magistrate can issue a warrant immediately under the proviso even though a summons was already issued.
Example 8: A magistrate in Hyderabad issues a summons to Sohan. Sohan does not appear. The magistrate issues a warrant for his arrest. When Sohan is arrested, he is brought before the magistrate, and the security proceedings continue.
