111. Order to be made.—When a Magistrate acting under section 107, section 108, section 109 or section 110, deems it necessary to require any person to show cause under such section, he shall make an order in writing, setting forth the substance of the information received, the amount of the bond to be executed, the term for which it is to be in force, and the number, character and class of sureties (if any) required.

What is this section about?

This section is a procedural rule that ensures fairness when a magistrate decides to take action under Sections 126, 127, 128, or 129 (which deal with security for keeping the peace and good behaviour). Before the magistrate can require a person to show cause (explain why they should not be ordered to give security), the magistrate must first issue a written order. This order must clearly state what the person is accused of, how much bond they need to give, how long the bond will last, and how many sureties are required.

What must the order contain?

The order must include four key pieces of information: (1) the substance of the information received - what the magistrate has heard about the person's behaviour; (2) the amount of the bond to be executed - how much money the person must promise to pay if they break the bond; (3) the term for which the bond is to be in force - how long the bond will last (up to one year for Sections 126-128, or up to three years for Section 129); and (4) the number, character, and class of sureties required - how many guarantors the person needs and what kind of people they should be.

Why is this section important?

This section is a safeguard against arbitrary action by the magistrate. By requiring a written order with specific details, it ensures that the person knows exactly what they are being accused of and what is expected of them. The person cannot be kept guessing. The written order also creates a record that can be reviewed by higher courts if the person challenges the order. It ensures transparency and procedural fairness.

What is the difference between old and new law?

The substance is similar, but there are some differences. In the old CrPC, the magistrate had to specify the "number, character and class of sureties (if any) required." In the new BNSS, the magistrate must specify the "number of sureties, after considering the sufficiency and fitness of sureties." The new law places a greater emphasis on the magistrate actively considering whether the sureties are sufficient and fit before specifying the number. This is a small but important shift towards ensuring that the sureties are actually capable of fulfilling their obligations. The new law also removes the word "character and class" and replaces it with a more practical test of "sufficiency and fitness." The sections referenced have also been renumbered.

Real-Life Example

Example 1: A magistrate in Lucknow receives information that Rakesh is likely to cause a breach of peace. Before taking action, the magistrate issues a written order under Section 111. The order states: "Information has been received that you are threatening shopkeepers. You are required to show cause why you should not execute a bond of ₹10,000 with one surety to keep the peace for 6 months." The order is served on Rakesh.

Example 2: A magistrate in Delhi receives information that Sanjay is disseminating seditious material. The magistrate issues a written order under Section 111 specifying that Sanjay must show cause why he should not execute a bond of ₹15,000 with two sureties for good behaviour for 1 year. The order sets out the substance of the information against Sanjay.

Example 3: A magistrate in Mumbai receives information that Priya, a habitual thief, has been released from prison. The magistrate issues a written order under Section 111 requiring Priya to show cause why she should not execute a bond of ₹20,000 with two sureties for good behaviour for 2 years. The order clearly states the grounds.

Example 4: A magistrate in Bengaluru issues a written order under Section 111 against Vikas for taking precautions to conceal his presence with intent to commit a cognizable offence. The order specifies a bond of ₹10,000 with one surety for 6 months. Vikas receives the order and knows exactly what is required.

Example 5: A magistrate in Patna issues an order under Section 111 against Gopal for habitual offences. The order sets out the information received, the bond amount of ₹25,000, the term of 3 years, and the requirement of two sureties. The order is served on Gopal, who then appears to show cause.

Example 6: A magistrate in Jaipur issues a written order against Meena under Section 111 but fails to specify the amount of the bond. The order is defective. Meena can challenge the order because it does not contain all the required elements. The magistrate must issue a fresh order.

Example 7: A magistrate in Chennai issues an order under Section 111 against Arjun. The order states the substance of the information but does not specify the number of sureties. Arjun's lawyer argues that the order is invalid. The magistrate corrects the order by adding the required details.

Example 8: A magistrate in Hyderabad issues a written order under Section 111 against Sohan. The order sets out all the required elements: the information received, the bond amount of ₹12,000, the term of 1 year, and the requirement of one surety. The order is valid and Sohan must comply.
