105L. Application of this Chapter.—The Central Government may, by notification in the Official Gazette, direct that the application of this Chapter in relation to a contracting State with which reciprocal arrangements have been made, shall be subject to such conditions, exceptions or qualifications as are specified in the said notification.

This is the final section of the reciprocal arrangements chapter (Chapter VII-A in CrPC, Chapter VIII in BNSS). It gives the Central Government a flexible power to decide how the provisions of this chapter will apply to different countries. This section allows the government to customize the application of the chapter based on the specific agreement India has with each country.

How does this work?

The Central Government can issue a notification in the Official Gazette. What is the difference between old and new law?

The substance is identical. The wording is exactly the same. The only difference is the location within the Act and the related sections. In the old CrPC, this is Section 105L at the end of Chapter VII-A. In the new BNSS, this is Section 124 at the end of Chapter VIII. The Central Government's power to issue notifications with conditions, exceptions, or qualifications remains exactly the same.

Real-Life Example

Example 1: The Central Government has made reciprocal arrangements with Country X for mutual legal assistance. However, Country X has a different standard of proof for evidence. The Central Government issues a notification under Section 105L stating that Chapter VII-A will apply to Country X only for offences punishable with imprisonment for 7 years or more, and that all requests must be accompanied by a certified translation. This is a condition under the notification.

Example 2: India has a treaty with Country Y. The Central Government issues a notification that Chapter VII-A will apply fully to Country Y without any conditions or exceptions. Country Y has a strong legal system and full cooperation with India. The notification reflects the complete application of the chapter.

Example 3: The Central Government receives a request from Country Z for assistance in a minor drug offence. However, the notification issued under Section 105L for Country Z excludes drug offences from the scope of the chapter. Example 4: The Central Government issues a notification under Section 105L applying the chapter to Country A, but with a qualification that the chapter only applies to offences committed after the date of the treaty. Any offence committed before the treaty date is excluded from the scope of the chapter. This is a qualification specified in the notification.

Example 5: Country B asks for assistance in tracing property in India. The notification under Section 105L for Country B includes a condition that all requests for property tracing must be accompanied by a court order from Country B's court. Without this court order, the Central Government cannot proceed with the request.

Example 6: The Central Government issues a notification that Chapter VII-A applies to Country C, but with an exception that requests for extradition of Indian citizens will not be entertained. This exception is specified in the notification. When Country C requests extradition of an Indian citizen, the Central Government refuses based on the exception.

Example 7: India has a reciprocal arrangement with Country D. The notification under Section 105L states that the chapter applies to Country D, but only for non-bailable offences.
