CrPC vs BNSS — Section-by-Section Comparison

Find the BNSS 2023 equivalent of every CrPC 1973 section, and the BNS 2023 equivalent of every IPC 1860 provision. In force from 1 July 2024.

Frequently Asked Questions

When did BNSS and BNS come into force?

Both the BNSS and BNS came into force on 1 July 2024. They apply to offences committed on or after that date. Pre-2024 cases continue to be governed by the old CrPC and IPC.

Is an FIR under CrPC 154 still valid after BNSS?

FIRs registered under Section 154 CrPC before 1 July 2024 continue to be investigated and tried under CrPC. New FIRs from 1 July 2024 onwards are registered under Section 173 BNSS.

What is the BNSS equivalent of anticipatory bail under CrPC 438?

Anticipatory bail is now covered under Section 482 BNSS. The substantive law is largely the same as CrPC Section 438.

What is the BNS equivalent of IPC 302 (murder)?

Murder is now covered under Section 103 BNS. The punishment — death or life imprisonment — remains identical to IPC 302.

Do CrPC cases already pending continue under CrPC or switch to BNSS?

As per Section 531 BNSS, cases pending as on 1 July 2024 continue to be governed by the old CrPC. BNSS applies only to cases where the offence was committed on or after 1 July 2024.
