180. Examination of witnesses by police. (1) Any police officer making an investigation under this Chapter, or any police officer not below such rank as the State Government may, by general or special order, prescribe in this behalf, acting on the requisition of such officer, may examine orally any person supposed to be acquainted with the facts and circumstances of the case. (2) Such person shall be bound to answer truly all questions relating to such case put to him by such officer, other than questions the answers to which would have a tendency to expose him to a criminal charge or to a penalty or forfeiture. (3) The police officer may reduce into writing any statement made to him in the course of an examination under this section; and if he does so, he shall make a separate and true record of the statement of each such person whose statement he records: Provided that statement made under this sub-section may also be recorded by audio-video electronic means: Provided further that the statement of a woman against whom an offence under section 64, section 65, section 66, section 67, section 68, section 69, section 70, section 71, section 74, section 75, section 76, section 77, section 78, section 79 or section 124 of the Bharatiya Nyaya Sanhita, 2023 is alleged to have been committed or attempted, shall be recorded, by a woman police officer or any woman officer.

This section describes the power of a police officer to examine or question a person during an investigation. If the police are investigating a crime, they can question anyone who might know something about it. This is a normal part of the investigation process to gather information and evidence.
Who can be questioned and who does the questioning? Any police officer who is investigating a case, or an officer of a specified rank acting on their behalf, can question any person who appears to know the facts of the case. There is no special format for the statement, and it is not a formal legal document like an affidavit. The person being questioned must answer all questions truthfully, except for questions that could make them admit to a crime or face a penalty. This is known as the 'right against self-incrimination' .
How is the statement recorded? The police officer can write down the statement. If they do, they must make a separate and true record of what each person says. Under the new law, statements can also be recorded through audio-video electronic means, such as a mobile phone or camera . The new law also has special provisions: if the victim is a woman and the offence is a crime against women (listed in the section), the statement must be recorded by a woman police officer or a woman officer .
What is the legal value of these statements? It's important to understand that a statement recorded under this section is not, by itself, considered evidence in court. It cannot be used to convict a person. Its primary purpose is to help the police in their investigation and to later contradict a witness if they change their story in court . The courts have held that such statements are only to prove contradictions or omissions, and cannot be a basis for conviction .

Example 1: In a theft case in Delhi, the investigating officer examines the neighbor, Rajesh, who saw a suspicious person near the house. The officer records Rajesh's statement in writing under Section 180 BNSS.
Example 2: In a road rage incident in Mumbai, the police officer investigating the case examines the victim, Anita, and her friend, Sunita, to understand the sequence of events. Both their statements are recorded separately.
Example 3: In Patna, during the investigation of a murder, the police question a key witness, Suresh. Suresh refuses to answer a question because it might incriminate him in another crime. He is within his rights under the second proviso of Section 180 BNSS.
Example 4: In Bengaluru, a woman reports a sexual assault. A woman police officer records her statement under Section 180 BNSS at the police station, as mandated by the law.
Example 5: In Lucknow, the investigating officer, while questioning a witness, decides to record the entire conversation on his mobile phone. This is allowed as statements can be recorded through audio-video electronic means.
Example 6: In a bribery case in Jaipur, the police examine the complainant, who gives a detailed statement. Later in court, the complainant changes his story. The prosecutor uses his statement recorded under Section 180 BNSS to contradict him and show that he is lying.
Example 7: In a case of assault in Chennai, the police officer questioning a witness does not write down the entire statement, only the key points. The court later holds that the investigating officer should have made a true and complete record of the statement.

बयान कैसे दर्ज किया जाता है? पुलिस अधिकारी बयान को लिख सकता है। अगर वे लिखते हैं, तो उन्हें हर व्यक्ति का बयान अलग-अलग और सही ढंग से दर्ज करना होता है। नए कानून के तहत, बयान को ऑडियो-वीडियो इलेक्ट्रॉनिक माध्यम (जैसे मोबाइल फोन या कैमरा) से भी रिकॉर्ड किया जा सकता है । नए कानून में यह भी प्रावधान है कि अगर पीड़िता एक महिला है और अपराध महिलाओं के खिलाफ किसी अपराध (धारा में सूचीबद्ध) का है, तो बयान एक महिला पुलिस अधिकारी या महिला अधिकारी द्वारा दर्ज किया जाना चाहिए ।
इन बयानों का कानूनी महत्व क्या है? यह समझना ज़रूरी है कि इस धारा के तहत दर्ज किया गया बयान अपने आप में अदालत में सबूत नहीं माना जाता है। इसका इस्तेमाल किसी को दोषी ठहराने के लिए नहीं किया जा सकता। इसका मुख्य उद्देश्य पुलिस को जाँच में मदद करना है और अगर कोई गवाह अदालत में अपनी बात बदलता है, तो उसे विरोधाभास (contradiction) दिखाने के लिए इस्तेमाल किया जा सकता है । अदालतों ने माना है कि ये बयान केवल विरोधाभास या चूक (omissions) को साबित करने के लिए हैं, और इनके आधार पर दोषसिद्धि नहीं की जा सकती ।

उदाहरण 1: दिल्ली में चोरी के मामले में, जाँच अधिकारी पड़ोसी राजेश से पूछताछ करता है, जिसने घर के पास एक संदिग्ध व्यक्ति को देखा था। अधिकारी BNSS की धारा 180 के तहत राजेश का बयान लिखकर दर्ज करता है।
