No complainant or witness on his way to any Court shall be required to accompany a police officer, or shall be subjected to unnecessary restraint or inconvenience, or required to give any security for his appearance other than his own bond: Provided that, if any complainant or witness refuses to attend or to execute a bond as directed in section 170, the officer in charge of the police station may forward him in custody to the Magistrate, who may detain him in custody until he executes such bond, or until the hearing of the case is completed.

In Simple Words (English)

This section protects people who have complained about a crime and people who are witnesses in a criminal case. The police cannot force such persons to travel with them to court or cause them unnecessary trouble, restrictions, or harassment.

A complainant or witness normally only has to give a personal bond for appearing before the court. The police cannot demand extra security, guarantees, or burdensome conditions merely because the person is a witness or complainant.

However, if a complainant or witness refuses to attend the court or refuses to execute the bond that the law requires, the police officer in charge may take that person before a Magistrate.

If the Magistrate finds that the person has refused to comply with the legal requirement, the Magistrate may keep that person in custody until the bond is executed or until the hearing of the case is completed. There is no separate punishment prescribed under this section.

Example 1: Anita from Jaipur witnessed a road accident and agreed to testify. The police cannot force her to travel with them to court or keep her under unnecessary restriction while she attends the hearing.

Example 2: Ramesh from Patna filed a theft complaint involving ₹45,000 stolen from his shop. The police cannot demand a cash security deposit from him for appearing in court.

Example 3: Suresh, a witness in a cheating case in Lucknow involving ₹2,50,000, was asked to execute a personal bond. He complied, so no further action could be taken against him.

Example 4: Kavita from Indore repeatedly refused to appear before the court despite lawful directions. The police produced her before the Magistrate, who required her to execute the bond.

Example 5: Mohan, a witness in a property dispute in Bhopal, was made to wait at the police station for long hours without reason before a court appearance. Such unnecessary inconvenience is prohibited by this section.

Example 6: Farzana from Hyderabad witnessed a fraud of ₹1,20,000. The police told her to arrange a guarantor before attending court. This demand would be contrary to this section.

Example 7: Deepak from Ranchi refused to sign the required bond in a criminal case. The officer in charge took him before the Magistrate, who detained him until he executed the bond.

यह धारा शिकायत करने वाले व्यक्ति और गवाहों की सुरक्षा के लिए बनाई गई है। पुलिस उन्हें जबरदस्ती अपने साथ कोर्ट ले जाने, बेवजह रोकने-टोकने या परेशान करने का अधिकार नहीं रखती।

अगर कोई व्यक्ति किसी मामले में गवाह है या उसने शिकायत की है, तो उससे आम तौर पर सिर्फ अपना निजी बॉन्ड देने को कहा जा सकता है। उससे अतिरिक्त जमानत या दूसरी सुरक्षा नहीं मांगी जा सकती।

ऐसी स्थिति में मजिस्ट्रेट उस व्यक्ति को तब तक हिरासत में रख सकता है जब तक वह बॉन्ड नहीं भर देता या मामले की सुनवाई पूरी नहीं हो जाती। इस धारा में अलग से कोई सजा तय नहीं की गई है।

उदाहरण 1: जयपुर की अनीता ने सड़क दुर्घटना अपनी आंखों से देखी थी। वह गवाही देने को तैयार थी। पुलिस उसे जबरदस्ती अपने साथ कोर्ट ले जाने या बेवजह रोककर रखने की हकदार नहीं है।

उदाहरण 2: पटना के रमेश की दुकान से ₹45,000 चोरी हो गए। उसने शिकायत दर्ज कराई। कोर्ट में आने के लिए पुलिस उससे नकद सुरक्षा राशि नहीं मांग सकती।

उदाहरण 3: लखनऊ में ₹2,50,000 की धोखाधड़ी के मामले में सुरेश गवाह था। उससे निजी बॉन्ड भरने को कहा गया और उसने भर दिया, इसलिए उसके खिलाफ कोई और कार्रवाई नहीं हुई।

उदाहरण 4: इंदौर की कविता को कई बार कोर्ट आने के लिए कहा गया लेकिन वह नहीं आई। तब पुलिस उसे मजिस्ट्रेट के सामने ले गई और बॉन्ड भरने को कहा गया।

उदाहरण 5: भोपाल के मोहन को गवाही देने जाना था, लेकिन पुलिस ने बिना किसी वजह के उसे घंटों थाने में बैठाए रखा। ऐसा करना इस धारा के खिलाफ है।

उदाहरण 6: हैदराबाद की फरजाना ने ₹1,20,000 की ठगी देखी थी। पुलिस ने उससे कहा कि कोर्ट आने से पहले कोई जमानती लेकर आओ। ऐसी मांग कानून के अनुसार गलत है।

उदाहरण 7: रांची के दीपक ने आपराधिक मामले में जरूरी बॉन्ड भरने से मना कर दिया। तब थाना प्रभारी उसे मजिस्ट्रेट के पास ले गया और बॉन्ड भरने तक हिरासत में रखा गया।
