(2) If he finds in such place any weights, measures or instruments for weighing which are false, he may seize the same, and shall forthwith give information of such seizure to a Magistrate having jurisdiction.

In Simple Words (English)

BNSS Section 172 is a new provision introduced in the Bharatiya Nagarik Suraksha Sanhita, 2023, which did not exist in the old CrPC. It creates a legal duty for every citizen to obey the lawful directions of a police officer. This duty specifically applies when the police officer is acting under Chapter XII of the BNSS, which covers the 'Preventive Action of the Police'. This means the police officer's directions must be related to preventing crimes, protecting public property, or maintaining public order, not for any other purpose.

The section also gives a police officer the power to take action if a person disobeys these directions. If someone resists, refuses to follow, ignores, or disregards a lawful direction, the police officer can detain or remove that person. The officer can then either produce the person before a magistrate or, in less serious cases, release them within 24 hours.

This provision was added to clarify the responsibilities of citizens and empower the police to enforce the law effectively. The purpose is to ensure that people cooperate with the police when they are working to prevent crime and maintain public safety. However, it also poses a significant scope for misuse and abuse of power, requiring the police to use this authority judiciously and within the bounds of the law.

This section itself does not contain any punishment or sentence like a fine or imprisonment. The power to detain is meant for immediate prevention and enforcement. However, if a person disobeys, they may face other legal consequences under different laws, such as the Bharatiya Nyaya Sanhita, for obstructing a public servant. The purpose is to ensure compliance with police directions to prevent crime and maintain public order.
