CODE OF CRIMINAL PROCEDURE (CRPC)

Section 152 CrPCPrevention of injury to public property.

Explained in Simple English & Hindi with Real-Life Examples

Original Text

152. Prevention of injury to public property. A police officer may of his own authority interpose to prevent any injury attempted to be committed in his view to any public property, movable or immovable, or the removal or injury of any public landmark or buoy or other mark used for navigation.

In Simple Words (English)

This section gives a police officer the power to step in and stop any damage that they see happening to public property. This is a preventive power that allows the police to act immediately without having to wait for orders from a superior or a magistrate.

What is 'public property' under this section? It includes movable things like vehicles or equipment belonging to the government, as well as immovable things like roads, government buildings, and public parks. It also specifically mentions 'public landmarks' like survey marks, boundary stones, and buoys or other markers used for navigation in water bodies.

When can this power be used? The police officer can only act if they see the damage being attempted or committed with their own eyes ("in his view"). They cannot act on hearsay or information. The officer can act on their own authority, meaning they do not need a warrant or prior permission. The purpose is to prevent the damage from happening or continuing.

This section does not impose a punishment itself. If the police officer stops someone from damaging public property, that person may be charged under other sections of the law for the actual offence (like mischief under the Bharatiya Nyaya Sanhita or Indian Penal Code). This section is purely about preventing the damage, not punishing it. The duty is to protect public property, which is meant for the use and benefit of all citizens.
