15. Subordination of Judicial Magistrates. (1) Every Chief Judicial Magistrate shall be subordinate to the Sessions Judge; and every other Judicial Magistrate shall, subject to the general control of the Sessions Judge, be subordinate to the Chief Judicial Magistrate. (2) The Chief Judicial Magistrate may, from time to time, make rules or give special orders, consistent with this Code, as to the distribution of business among the Judicial Magistrates subordinate to him.

This section establishes the chain of command or hierarchy among Judicial Magistrates. It clearly states that every Chief Judicial Magistrate is subordinate to the Sessions Judge. This means the Sessions Judge is the superior authority over the Chief Judicial Magistrate. The Chief Judicial Magistrate must follow the directions and orders of the Sessions Judge.

The section also says that every other Judicial Magistrate (who is not the Chief Judicial Magistrate) is subordinate to the Chief Judicial Magistrate. Any rules or orders he makes must be consistent with the provisions of the CrPC (or BNSS).

Example 1: The Sessions Judge of Pune district noticed that the Chief Judicial Magistrate was not following proper procedures in allocating cases. The Sessions Judge issued a directive to the CJM under his supervisory powers, and the CJM had to comply because he is subordinate to the Sessions Judge under Section 15(1).

Example 2: The Chief Judicial Magistrate of Lucknow passed an order distributing all pending cheque bounce cases equally among the five Judicial Magistrates in the district. One magistrate objected, but the CJM reminded him that under Section 15(2), the CJM has the power to make such rules for distribution of business.

Example 3: A Judicial Magistrate in Jaipur wanted to take a long leave. He had to get approval from the Chief Judicial Magistrate because all magistrates are subordinate to the CJM under Section 15(1). The CJM had the authority to approve or reject the leave application.

Example 4: The Sessions Judge of Ahmedabad observed that the Chief Judicial Magistrate was overburdened with administrative work. The Sessions Judge directed the CJM to delegate some administrative powers to a senior Judicial Magistrate. The CJM complied because he is subordinate to the Sessions Judge.

Example 5: The Chief Judicial Magistrate of Patna noticed that two Judicial Magistrates were handling very few cases while others were overburdened. He used his power under Section 15(2) to issue a special order redistributing the cases equally among all magistrates.

Example 6: A Judicial Magistrate in Chennai disagreed with a circular issued by the Chief Judicial Magistrate about working hours. He complained to the Sessions Judge. The Sessions Judge, having general control over the CJM, reviewed the matter and modified the circular. The CJM had to follow the Sessions Judge's decision.

Example 7: The Chief Judicial Magistrate of Kolkata made a rule that all Judicial Magistrates must send their daily case disposal reports to him by 5 PM. One magistrate failed to comply. The CJM, under his authority, issued a warning and directed the magistrate to follow the rule strictly.

Example 8: The Sessions Judge of Bangalore transferred a Judicial Magistrate from one court to another without consulting the Chief Judicial Magistrate. The CJM could not object because the CJM himself is subordinate to the Sessions Judge under Section 15(1).

Example 9: The Chief Judicial Magistrate of Bhopal created a special roster for handling urgent night bail applications, assigning one magistrate per week for night duty. This was done under his power to distribute business under Section 15(2). All magistrates had to follow this roster.

Example 10: A Judicial Magistrate in Hyderabad was given additional charge of a special court by the Chief Judicial Magistrate. When the magistrate refused, stating workload issues, the CJM reminded him that all magistrates are subordinate to the CJM and must accept the distribution of business as ordered.
