10. Subordination of Assistant Sessions Judges. (1) All Assistant Sessions Judges shall be subordinate to the Sessions Judge in whose Court they exercise jurisdiction. (2) The Sessions Judge may, from time to time, make rules consistent with this Code, as to the distribution of business among such Assistant Sessions Judges. (3) The Sessions Judge may also make provision for the disposal of any urgent application, in the event of his absence or inability to act, by an Additional or Assistant Sessions Judge, or, if there be no Additional or Assistant Sessions Judge, by the Chief Judicial Magistrate, and every such Judge or Magistrate shall be deemed to have jurisdiction to deal with any such application.

This section explains the relationship between a Sessions Judge and the Assistant Sessions Judges working under him. All Assistant Sessions Judges must follow the directions of the Sessions Judge of that court. The Sessions Judge is their superior, and they are subordinate to him.
The Sessions Judge has the power to make rules about how work is shared among the Assistant Sessions Judges. This means the Sessions Judge can decide which judge will hear which type of case or which specific cases. This helps in the smooth functioning of the court.
If the Sessions Judge is absent or unable to work due to some reason, he can make arrangements for urgent applications. He can ask an Additional or Assistant Sessions Judge to handle those urgent matters. If no such judge is available, the Chief Judicial Magistrate can also handle urgent applications. Any judge or magistrate handling such urgent work will have the legal power to do so.

Example 1: The Sessions Judge of Jaipur fell ill suddenly. Five urgent bail applications were pending. Under CrPC Section 10(3), the Sessions Judge had already passed a general order allowing the Senior Assistant Sessions Judge to handle such urgent matters. The Senior Assistant Sessions Judge heard and disposed of all five applications the same day.
Example 2: In Mumbai Sessions Court, the Sessions Judge observed that Assistant Sessions Judge Patil was taking too many property dispute cases while Assistant Sessions Judge Sharma was sitting idle. The Sessions Judge used his power under CrPC Section 10(2) to issue new rules redistributing the cases equally between both judges.
Example 3: The only Assistant Sessions Judge in a small district court was on leave for a week. A murder accused filed an urgent appeal for bail. Since no Assistant Sessions Judge was available, the Sessions Judge (who was also handling higher court matters) directed the Chief Judicial Magistrate under Section 10(3) to hear and decide the urgent bail application.
Example 4: A new Assistant Sessions Judge was posted in Lucknow. The Sessions Judge gave him written instructions under Section 10(2) that he would only handle cases related to theft and robbery, while the more experienced Additional Sessions Judge would handle murder and rape cases.
Example 5: During a lawyer's strike in Patna, the Sessions Judge was transferred and a new judge had not yet joined. An urgent petition regarding illegal detention was filed.
