Explained in Simple English & Hindi with Real-Life Examples

Original Text

142. (1) If a Magistrate making an order under section 133 considers that immediate measures should be taken to prevent imminent danger or injury of a serious kind to the public, he may issue such an injunction to the person against whom the order was made, as is required to obviate or prevent such danger or injury pending the determination of the matter. (2) In default of such person forthwith obeying such injunction, the Magistrate may himself use, or cause to be used, such means as he thinks fit to obviate such danger or to prevent such injury. (3) No suit shall lie in respect of anything done in good faith by a Magistrate under this section.

In Simple Words (English)

What is this section about?

This section gives magistrates the power to act quickly in emergency situations. When a magistrate issues a conditional order under Section 152 (BNSS) / 133 (CrPC) to remove a nuisance, there is usually a time gap before the order becomes final. During this gap, there might be an immediate danger to the public. This section allows the magistrate to issue an emergency injunction - a temporary order requiring immediate action - to prevent imminent danger or serious injury while the final decision is pending.

What is an injunction?

An injunction is a court order that requires a person to do something or to stop doing something. In this context, it is a temporary order that tells the person responsible for the nuisance to take immediate steps to prevent danger. For example, if a building is about to collapse, the magistrate can issue an injunction ordering the owner to immediately evacuate the building or put up supports, even before the full hearing is completed.

What happens if the person disobeys the injunction?

Sub-section (2) gives the magistrate teeth. If the person does not immediately obey the injunction, the magistrate can take direct action. The magistrate can themselves use, or cause to be used, whatever means are necessary to prevent the danger. For example, the magistrate can order the evacuation of the building, or can have the building demolished, or can fence the dangerous area. The magistrate acts to protect the public, even if the owner objects.

What is the protection for the magistrate?

Sub-section (3) provides legal protection. No lawsuit can be filed against the magistrate for anything done in good faith under this section. This protects the magistrate from being sued for damages when they take emergency action to protect the public. However, the protection only applies if the action was done in good faith - honestly and reasonably.

What is the difference between old and new law?

The substance is identical. The only differences are the section references: the old CrPC refers to Section 133, while the new BNSS refers to Section 152. The power to issue emergency injunctions, the consequence of disobedience, and the protection for magistrates remain exactly the same.

Real-Life Example

Example 1: A magistrate in Lucknow issues a conditional order under Section 133 to demolish a dangerous building. Before the order becomes absolute, the magistrate sees that the building is about to collapse and could kill pedestrians. The magistrate issues an emergency injunction under Section 142 ordering the owner to immediately erect barricades and evacuate the building. The owner refuses. The magistrate himself causes the barricades to be erected.

Example 2: A magistrate in Delhi issues a conditional order to stop a harmful chemical leak. Before the hearing, the magistrate learns that the leak is worsening and could cause serious health problems. The magistrate issues an injunction ordering the factory to immediately stop the leak. The factory owner disobeys. The magistrate causes the leak to be stopped using emergency measures.

Example 3: A magistrate in Mumbai issues a conditional order to remove an obstruction from a railway track. Before the order becomes final, the magistrate learns that a train is approaching. The magistrate issues an injunction ordering the immediate removal of the obstruction. The person disobeys. The magistrate causes the obstruction to be removed immediately.

Example 4: A magistrate in Bengaluru issues a conditional order to fence a well. Before the order becomes final, a child falls into the well. The magistrate issues an injunction ordering the immediate fencing of the well. The owner does not comply. The magistrate causes the well to be fenced immediately.

Example 5: A magistrate in Patna issues a conditional order to remove a tree that is about to fall. Before the order becomes final, a storm is forecast. The magistrate issues an injunction ordering the immediate removal of the tree. The owner refuses. The magistrate causes the tree to be cut down.

Example 6: A magistrate in Jaipur issues a conditional order to stop a public nuisance. Before the hearing, the magistrate finds that the nuisance is causing immediate health problems. The magistrate issues an injunction. The person complies immediately, and no further action is needed.

Example 7: A magistrate in Chennai issues an injunction under Section 142. The person affected sues the magistrate for damages. Under Section 142(3), the court dismisses the suit because the magistrate acted in good faith. The magistrate is protected.

Example 8: A magistrate in Hyderabad issues an injunction. The magistrate's action is challenged as being unreasonable. The court reviews the action and finds that the magistrate acted in good faith and had reasonable grounds for the injunction. The injunction is upheld.
