In Simple Words (English)
What is this section about?
This section ensures that a maintenance order can be enforced anywhere in India. Once a Magistrate passes a maintenance order under Section 144 (BNSS) / 125 (CrPC), the person who benefits from the order receives a copy of the order free of cost. This copy is like a legal document that proves the right to receive maintenance. The order can then be enforced by any Magistrate in any place where the person who is supposed to pay the maintenance is located.
What does "free of cost" mean?
The copy of the order is given without payment. The person receiving maintenance does not have to pay any fees or charges to get a copy of the order. This is important because the person seeking maintenance is often financially dependent and may not be able to afford court fees. The law ensures they get the document they need to enforce their rights.
Who can enforce the order?
The maintenance order can be enforced by any Magistrate, not just the Magistrate who passed the original order. This is a very practical provision. If the person who is supposed to pay maintenance moves to another city or state, the person receiving maintenance can approach a Magistrate in that location to enforce the order. The Magistrate only needs to be satisfied about two things: the identity of the parties (that the person claiming maintenance is the right person) and that the maintenance has not been paid.
What is the practical effect?
This section makes maintenance orders portable across India. Without this provision, a woman would have to go back to the original court every time her husband defaulted on payments, even if she had moved to a different city. This section allows her to approach a local Magistrate wherever she is living. The local Magistrate can then take action to enforce the order - such as issuing a warrant to recover the arrears or ordering imprisonment for default.
What is the difference between old and new law?
The substance is identical. The only difference is the section references: the old CrPC Section 128 refers to Section 125, while the new BNSS Section 147 refers to Section 144. The provision that a free copy of the order be given and that it can be enforced by any Magistrate anywhere in India remains exactly the same.
Real-Life Example
Example 1: A Magistrate in Lucknow passes a maintenance order of ₹10,000 per month in favour of Sunita against her husband Rakesh. Sunita receives a free copy of the order. Rakesh moves to Mumbai and stops paying. Sunita approaches a Magistrate in Mumbai with a copy of the order. The Mumbai Magistrate, satisfied about the identity and non-payment, enforces the order.
Example 2: A woman named Priya in Delhi obtains a maintenance order against her husband Sanjay. Sanjay moves to Bengaluru and defaults on payments. Priya takes the order copy to a Magistrate in Bengaluru. The Magistrate confirms the identity and non-payment and issues a warrant to recover the arrears.
Example 3: A maintenance order is passed in Chennai in favour of Meena. Meena moves to Hyderabad with her children. Her ex-husband stays in Chennai and stops paying. Meena approaches a Magistrate in Hyderabad. The Hyderabad Magistrate enforces the order by issuing notices to the ex-husband in Chennai.
Example 4: A father in Patna is ordered to pay maintenance for his child. The father moves to Kolkata and stops paying. The mother, who has the maintenance order copy, approaches a Magistrate in Kolkata. The Magistrate enforces the order against the father in Kolkata.

Example 8: A woman in Hyderabad receives a maintenance order copy free of cost under Section 128. She does not have to pay any fee for the copy. She later uses this copy to enforce the order when her husband moves to another city.
