Original Text

168. Report of investigation by subordinate police officer. (1) When any subordinate police officer has made any investigation under this Chapter, he shall report the result of such investigation to the officer in charge of the police station. (2) The officer in charge shall thereupon, or where so directed by any Magistrate, or the Superintendent of Police, may, make a report to the Magistrate, under section 173.

In Simple Words (English)

This section deals with the reporting structure within the police force after an investigation is conducted by a subordinate officer. It ensures that the results of an investigation are properly communicated up the chain of command.

When does this apply? This applies whenever a police officer below the rank of the officer in charge of a police station conducts an investigation. Such an officer might be a constable or a head constable who has been deputed to investigate a crime. The investigation could be for any offence under the chapter on investigation.

What is the procedure? The subordinate officer must report the results of their investigation to the officer in charge of the police station. This is the first step in the chain of reporting. The officer in charge then has the authority to make a final report to the Magistrate under Section 193 of the BNSS (or Section 173 of the CrPC). The officer in charge can also be directed by a Magistrate or a Superintendent of Police to prepare this report. The final report to the Magistrate is usually in the form of a chargesheet or a final report.

This section does not impose any punishment. It is a procedural rule that creates a clear line of communication and accountability within the police department. It ensures that the officer in charge is aware of the investigation's outcome and can properly prepare the final report for the court.
