BHARATIYA NAGARIK SURAKSHA SANHITA (BNSS)

Section 186 BNSSWhen officer in charge of police station may require another to issue search-warrant.

Explained in Simple English & Hindi with Real-Life Examples

Original Text

186. When officer in charge of police station may require another to issue search-warrant. (1) An officer in charge of a police station or a police officer not being below the rank of sub-inspector making an investigation may require an officer in charge of another police station, whether in the same or a different district, to cause a search to be made in any place, in any case in which the former officer might cause such search to be made within the limits of his own station. (2) Such officer, on being so required, shall proceed according to the provisions of section 185, and shall forward the thing found, if any, to the officer at whose request the search was made. (3) Nothing in this section shall be deemed to prevent such officer from securing any person found in the place, or, with a view to the investigation of the offence, from seizing any thing found therein, which he has reason to believe to be connected with such offence, and taking or sending it to the police station of the officer who required the search to be made.

In Simple Words (English)

This section allows a police officer to ask a police officer in another police station (in the same or a different district) to conduct a search. This is useful when evidence is located outside the jurisdiction of the investigating officer's own police station.

Who can make this request and when? An officer in charge of a police station, or a police officer of the rank of Sub-Inspector or above who is investigating a case, can make this request. They can do this whenever they could have conducted the search themselves if the place was within their own police station limits. This ensures that the power to search without a warrant under Section 185 of the BNSS (or Section 165 of the CrPC) can be extended to another jurisdiction.

What is the procedure? The officer who receives the request must proceed according to the rules of Section 185 BNSS (or 165 CrPC). This means they must record their reasons for the search and follow the other procedures, including videography under the new law. If anything is found during the search, it must be sent to the officer who made the original request.

What about other powers? This section also allows the officer conducting the search to secure any person found at the place and seize any item they believe is connected to the offence. They can then send the seized items to the police station of the officer who requested the search. This section does not impose any punishment. It is a procedural power that facilitates cross-jurisdictional cooperation during an investigation.
