BHARATIYA NAGARIK SURAKSHA SANHITA (BNSS)
Section 182 BNSS — No inducement to be offered.
Explained in Simple English & Hindi with Real-Life Examples
Original Text
182. No inducement to be offered. (1) No police officer or other person in authority shall offer or make, or cause to be offered or made, any such inducement, threat or promise as is mentioned in section 23 of the Bharatiya Sakshya Adhiniyam, 2023. (2) But no police officer or other person shall be deemed to be a person in authority merely because he is a police officer.
In Simple Words (English)
This section protects people from being pressured into making a confession or statement by the police. It says that a police officer or any other person in authority cannot offer or make any inducement, threat, or promise to a person that could make them confess to a crime.
What does this mean in practice? An 'inducement' could be a promise of a lighter punishment or some other benefit. A 'threat' could be intimidation or the promise of harm. A 'promise' could be a guarantee of reward or leniency. The purpose of this rule is to ensure that any confession or statement made to the police is voluntary and not obtained by coercion or unfair means.
The law also clarifies who is considered a 'person in authority'. It says that a police officer is not automatically considered a person in authority just because of their job. However, the courts have interpreted this differently. Many courts have held that a police officer is indeed a person in authority for the purposes of this section. The phrase is meant to include anyone who has the power to influence the person being questioned, whether they are a police officer, a magistrate, or any other official.
This section does not impose a punishment by itself. It is a rule that is used to determine whether a confession is admissible as evidence in court. If a confession is obtained through an inducement, threat, or promise, it becomes inadmissible under the law of evidence (Section 23 of the Bharatiya Sakshya Adhiniyam, 2023). The purpose is to protect the rights of the accused and ensure that confessions are reliable and given voluntarily.
Real-Life Example
Example 1: A police officer in Delhi is questioning a suspect, Ramesh, about a theft. The officer tells Ramesh, "If you confess, I'll make sure the judge is lenient with you." This is an inducement and is prohibited under Section 182 BNSS. Any confession made as a result would not be admissible in court.
Example 2: In Mumbai, a police officer investigating a murder threatens a witness, Anita, by saying, "If you don't tell us what you saw, we will arrest you as a suspect." This is a threat and is prohibited.
Example 3: In Patna, a senior officer promises a suspect, Suresh, that if he confesses to the crime, the police will drop a separate minor charge against him. This is a promise and is forbidden.
Example 4: During an investigation in Lucknow, the investigating officer tells a suspect, "If you tell the truth, you will be released on bail immediately." This is a promise of a benefit and violates Section 182 BNSS.
Example 5: In Bengaluru, a police officer is questioning a person about a cheating case. The officer does not make any promise or threat but simply says, "You can tell us whatever you want, voluntarily." This is not a violation, as no inducement is offered.
Example 6: In Jaipur, the police are interrogating a person, Vikram. A magistrate is present in the room. The magistrate says, "If you confess, I will consider it in your favour." The magistrate, as a person in authority, is also prohibited from making such an inducement.
