181. Statements to police and use thereof. (1) No statement made by any person to a police officer in the course of an investigation under this Chapter, shall, if reduced to writing, be signed by the person making it; nor shall any such statement or any record thereof, whether in a police diary or otherwise, or any part of such statement or record, be used for any purpose, save as hereinafter provided, at any inquiry or trial in respect of any offence under investigation at the time when such statement was made: Provided that when any witness is called for the prosecution in such inquiry or trial whose statement has been reduced into writing as aforesaid, any part of his statement, if duly proved, may be used by the accused, and with the permission of the Court, by the prosecution, to contradict such witness in the manner provided by section 148 of the Bharatiya Sakshya Adhiniyam, 2023; and when any part of such statement is so used, any part thereof may also be used in the re-examination of such witness, but for the purpose only of explaining any matter referred to in his cross-examination. (2) Nothing in this section shall be deemed to apply to any statement falling within the provisions of clause (a) of section 26 of the Bharatiya Sakshya Adhiniyam, 2023; or to affect the provisions of the proviso to sub-section (2) of section 23 of that Adhiniyam. Explanation.—An omission to state a fact or circumstance in the statement referred to in sub-section (1) may amount to contradiction if the same appears to be significant and otherwise relevant having regard to the context in which such omission occurs and whether any omission amounts to a contradiction in the particular context shall be a question of fact.

This section sets out important rules about statements that people make to the police during an investigation. It ensures that these statements are used fairly and not misused against anyone.
The main rule is that a statement recorded by the police during an investigation cannot be used as evidence in court. This means the police cannot use your statement to prove you are guilty or to support their case. The statement is not a formal piece of evidence like testimony given under oath in court. Also, the police cannot ask you to sign your statement. This rule is to protect people from being pressured by the police.
There is one exception to this rule. The statement can be used to 'contradict' a witness. For example, if a witness tells the police one thing during the investigation, but says something different in court, the statement can be used to show the judge that the witness is not telling the truth. The statement can only be used to point out the difference, not to prove something is true. The law also says that if a witness simply forgot to mention something in their police statement, and that omission is important and relevant, it can be treated as a contradiction .
This section does not impose a punishment. If a person disobeys an order related to this section, they may face consequences under other laws. The purpose is to control how police statements can be used to prevent injustice and ensure that trials are fair.
Real-Life Example
Example 1: In a theft case in Delhi, the investigating officer records the statement of a witness, Ramesh. Ramesh tells the police he saw the accused running away from the house. In court, Ramesh says he is not sure if it was the accused. The prosecutor can use Ramesh's police statement to contradict him and show that he had earlier identified the accused.
Example 2: In a murder investigation in Mumbai, the police record the statement of a key witness, Anita. Anita's statement is not signed by her, as the law does not allow it. Later in court, the defence lawyer tries to use the statement to point out a contradiction in Anita's testimony.
Example 3: In Patna, a witness, Suresh, gives a statement to the police about a fight. In his statement, he does not mention that the accused had a knife. In court, he testifies that the accused had a knife. The judge may consider this omission as a contradiction if it is significant to the case.
Example 4: In Bengaluru, during the trial of a cheating case, the prosecution wants to use a witness's police statement to support their case. The court disallows this because the statement cannot be used to prove the truth of the matter, only to contradict the witness.
Example 5: In Lucknow, a witness, Vikram, gives a statement to the police. Later, the accused's lawyer wants to use the statement to question the witness. The lawyer must first show the relevant part of the statement to the witness and ask if they had made that statement. This is the procedure for using a statement to contradict a witness.
Example 6: In Jaipur, a witness, Sunita, changes her story in court. The accused's lawyer uses the proviso to Section 181 BNSS to show that Sunita's court testimony contradicts her earlier statement to the police, thereby discrediting her.
Example 7: In a case of assault in Chennai, the investigating officer asks the injured person, Arjun, to sign his statement. The officer does this because he is unaware of the rule. The court later states that the statement is not invalid just because it is signed, but the officer's action is against the law and can be criticized .
