170. Arrest to prevent commission of cognizable offences. (1) A police officer knowing of a design to commit any cognizable offence may arrest, without orders from a Magistrate and without a warrant, the person so designing, if it appears to such officer that the commission of the offence cannot be otherwise prevented. (2) No person arrested under sub-section (1) shall be detained in custody for a period exceeding twenty-four hours from the time of his arrest unless his further detention is required or authorised under any other provisions of this Sanhita or of any other law for the time being in force.

This section gives a police officer the power to arrest a person without a warrant from a magistrate to prevent that person from committing a crime. This is called a 'preventive arrest' because its purpose is to stop an offence before it happens, not to punish someone for a crime they have already committed.

When can this power be used? The police officer must know that the person has a design or plan to commit a 'cognizable offence' (a serious crime like murder, robbery, or theft). The officer must also be satisfied that the crime cannot be prevented in any other way. For example, the officer might have reliable information that the person is about to rob a house, and that arresting them is the only way to stop the robbery. Courts have held that the police must have real knowledge and a genuine opinion based on facts, not just suspicion or whims, to make a valid arrest under this section .

What happens after the arrest? This section itself is very short and does not provide for a punishment. If a person is arrested under this section, they cannot be kept in custody for more than 24 hours from the time of arrest. If the police want to keep the person longer, they must get permission under some other provision of the law, such as Section 187 of the BNSS (which deals with remand for investigation) . The police cannot simply hold a person indefinitely.

This section is a powerful tool for maintaining public order and preventing crime. However, because it involves taking away a person's liberty without a warrant, it must be used carefully and only when the conditions are strictly met. Misuse of this power can lead to legal action against the police officer . The BNSS has not changed the text of this section from the old CrPC, so the same rules and court judgments apply .

If the officer has prior knowledge of Ramesh's design and reasonably believes the robbery cannot be otherwise prevented, he can arrest Ramesh under this section.

Example 7: In Gujarat, a person is known to be a habitual offender who has been threatening to kill his business partner. The police officer, having knowledge of this design, arrests him to prevent the potential murder.
