169. Information of design to commit cognizable offences. Every police officer receiving information of a design to commit any cognizable offence shall communicate such information to the police officer to whom he is subordinate, and to any other officer whose duty it is to prevent or take cognizance of the commission of any such offence.

In Simple Words (English)

This section places a duty on every police officer to share information about a planned crime with their superiors and other officers who are responsible for preventing or dealing with such crimes.

The duty applies whenever a police officer receives any information about a plan or design to commit a cognizable offence. A cognizable offence is a serious crime where police can arrest without a warrant, like murder, theft, or robbery.

The information must be communicated to two types of officers: (1) the officer to whom the police officer is subordinate (their immediate superior), and (2) any other officer whose duty is to prevent or take action (cognizance) of such offences.

This section itself does not contain a punishment. It creates a duty to report. If a police officer fails to report information about a planned crime, they may face departmental action. The purpose is to ensure that information about planned crimes flows up the chain of command so that preventive action can be taken. This section works together with Section 149 (duty to prevent offences) and Section 151 (power of preventive arrest) .

Example 1: A police constable in Delhi receives a tip from an informant that a group is planning to rob a bank in Connaught Place next week. The constable immediately reports this information to his Station House Officer (SHO) and the crime branch officials. This allows them to plan and prevent the robbery.

Example 2: In Mumbai, a police officer overhears a conversation in a local market about a plan to kidnap a businessman's son for ransom. The officer reports the information to his superior and to the Anti-Extortion Cell of the Mumbai Police.

Example 3: A police patrolling party in Lucknow sees a group of people discussing a plan to attack a rival group during an upcoming political rally. They immediately inform their supervisor and the local intelligence unit about this design.

Example 4: In Chennai, a police officer receives information that a known criminal is planning to smuggle a large quantity of gold through the airport. He communicates this information to the customs department and his police superiors.
