162. Magistrate may prohibit repetition or continuance of public nuisance. A District Magistrate or Sub-divisional Magistrate, or any other Executive Magistrate or Deputy Commissioner of Police empowered by the State Government or the District Magistrate in this behalf, may order any person not to repeat or continue a public nuisance, as defined in the Bharatiya Nyaya Sanhita, 2023, or any special or local law.

In Simple Words (English)

This section gives certain high-ranking government officials the power to stop a person from continuing to create a public nuisance. A public nuisance is something that causes harm, danger, or annoyance to the public at large. It is not just a personal problem between two people.

Who can use this power? A District Magistrate, Sub-Divisional Magistrate, or any other Executive Magistrate who has been given this authority by the State Government or the District Magistrate can issue such an order. Under the new law (BNSS), a Deputy Commissioner of Police has also been given this power.

For this section to apply, the Magistrate must be satisfied that a person is repeating or continuing a public nuisance. The nuisance must be defined as a public nuisance under the Bharatiya Nyaya Sanhita (or Indian Penal Code under the old law) or any other special or local law. The Magistrate will then order that person to stop.

This section is a preventive measure. It does not impose a punishment like jail or a fine on its own. If the person disobeys the order, they may be punished under other laws. The purpose is to stop a problem quickly and maintain public peace and health.

Real-Life Example

Example 1: A factory in Kanpur is releasing toxic smoke that is making nearby residents sick. The District Magistrate issues an order under this section directing the factory owner to stop the emission immediately.

Example 2: A group of people in Mumbai has been playing loud music every night until 2 AM, disturbing the entire neighborhood. The Sub-Divisional Magistrate passes an order prohibiting them from playing music after 10 PM.

Example 3: A farmer in Punjab is burning crop stubble, causing severe air pollution and visibility issues on the highway. The Deputy Commissioner of Police, authorized by the District Magistrate, orders him to stop the burning.

Example 4: A shopkeeper in Lucknow has set up a loudspeaker outside his shop and is playing advertisements at high volume, causing a nuisance to patients in a nearby hospital. The Executive Magistrate orders him to remove the loudspeaker.

Example 5: A person in Varanasi has been dumping construction waste on a public road, blocking traffic and creating a hazard for pedestrians. The District Magistrate orders him to clear the waste and not to dump any more.

Example 6: A temple in a residential colony in Delhi has been using a public address system for prayers five times a day at very high volume, disturbing students and elderly people. The Magistrate issues an order to restrict the volume.

Example 7: A hotel in Jaipur is letting its dirty water flow onto the street, creating a foul smell and a breeding ground for mosquitoes. The Sub-Divisional Magistrate orders the hotel owner to stop this and fix the drainage.

Example 8: A political party in Kolkata puts up thousands of posters and flags on public electric poles and trees, causing a visual mess and risking electrical hazards. The Magistrate orders them to remove the posters and stop pasting new ones.

यह धारा कुछ बड़े अधिकारियों को यह अधिकार देती है कि वे किसी व्यक्ति को सार्वजनिक उपद्रव करने से रोक सकें। सार्वजनिक उपद्रव का मतलब है ऐसा काम जिससे आम जनता को नुकसान, खतरा या परेशानी हो। यह दो लोगों का निजी झगड़ा नहीं है।

उदाहरण 2: मुंबई में कुछ लोग हर रात 2 बजे तक तेज आवाज में गाना बजाते हैं, जिससे पूरे मोहल्ले को परेशानी होती है। उप-मंडल मजिस्ट्रेट ने उन्हें रात 10 बजे के बाद गाना बजाने से मना कर दिया।
