In Simple Words (English)
What is this section about?
This section gives magistrates two important tools to help them decide nuisance cases under Sections 156-157 (BNSS) / 137-138 (CrPC). First, the magistrate can order a local investigation - meaning they can send someone to physically inspect the location where the nuisance is alleged to exist. Second, the magistrate can summon an expert to give their professional opinion on the matter.
What is a local investigation?
A local investigation is when the magistrate directs a person to go to the site and inspect it. For example, if there is a dispute about a blocked drainage channel, the magistrate can send an officer to inspect the channel, take measurements, talk to local residents, and report back. This gives the magistrate first-hand information about the actual situation on the ground, which is much better than just relying on written statements.
Who can be appointed for a local investigation?
The magistrate can appoint "such person as he thinks fit." This could be a police officer, a revenue official, a municipal engineer, or any other competent person. The magistrate has discretion to choose the most appropriate person based on the nature of the nuisance. The person conducting the investigation must then submit a report to the magistrate.
What about expert examination?
The magistrate can also summon and examine an expert. For example, if the case involves a dangerous building, the magistrate can summon a structural engineer to examine the building and give evidence. If the case involves pollution, the magistrate can summon a environmental expert. The expert will give their opinion based on their professional knowledge, which can be crucial in deciding the case.
What is the difference between old and new law?
The substance is identical. The only differences are the section references: the old CrPC refers to Sections 137 and 138, while the new BNSS refers to Sections 156 and 157. The power to order local investigations and to summon experts remains exactly the same.
Real-Life Example
Example 1: A magistrate in Lucknow is hearing a case about a blocked drain that is causing a nuisance. The magistrate orders a local investigation under Section 139. A municipal engineer is sent to inspect the drain, measure the blockage, and report back. The engineer's report helps the magistrate decide the case.
Example 2: A magistrate in Delhi is hearing a case about a dangerous building. The magistrate summons a structural engineer as an expert under Section 139(b). The engineer examines the building, gives evidence about its condition, and testifies that it is at risk of collapse. The magistrate relies on the expert's testimony to make the order absolute.
Example 3: A magistrate in Mumbai is hearing a case about a trade that is allegedly polluting the air. The magistrate orders a local investigation. An environmental officer visits the site, takes air samples, and submits a report. The report shows high levels of pollution, which helps the magistrate decide the case.
Example 4: A magistrate in Bengaluru is hearing a case about an unfenced well. The magistrate orders a local investigation. A revenue official visits the site, measures the distance from the well to the public road, and reports on the danger. The magistrate uses the report to decide whether to make the order absolute.
