155. If the person against whom an order is made under section 154 does not perform such act or appear and show cause, he shall be liable to the penalty specified in that behalf in section 223 of the Bharatiya Nyaya Sanhita, 2023, and the order shall be made absolute.

What is this section about?
This section deals with the consequences when a person ignores a conditional order issued under Section 152 (BNSS) / 133 (CrPC). If the person does not do what the order requires (like removing a nuisance) AND does not appear in court to show cause, then two things happen: first, the person becomes liable to a penalty; second, the conditional order becomes absolute (final and enforceable).
What is the penalty?
Under the old law, the penalty was specified in Section 188 of the Indian Penal Code. Under the new law, it is specified in Section 223 of the Bharatiya Nyaya Sanhita. Section 188 IPC / Section 223 BNS deals with disobedience to an order lawfully promulgated by a public servant. The punishment can include simple imprisonment for up to one month, or a fine of up to two hundred rupees, or both. If the disobedience causes or tends to cause danger to human life, health, or safety, or causes a riot or affray, the punishment can be imprisonment for up to six months, or a fine of up to one thousand rupees, or both.
What does "the order shall be made absolute" mean?
When the order is made absolute, it means the conditional order becomes final and binding. The person can no longer challenge it. The magistrate can then take steps to enforce the order, such as causing the nuisance to be removed at the person's expense. The person loses the opportunity to argue against the order.
Why is this section important?
This section gives teeth to the nuisance removal orders. Without a penalty, people could simply ignore the orders with no consequences. This section ensures that there is a real consequence for non-compliance, whether by carrying out the act required or by appearing in court to argue. It compels people to take the order seriously.
What is the difference between old and new law?
The substance is nearly identical. The main difference is the cross-reference: the old CrPC referred to Section 188 of the IPC, while the new BNSS refers to Section 223 of the BNS, which is the corresponding provision. The section references (133 to 152, 135 to 154) have also been updated. The penalty itself and the requirement that the order becomes absolute remain exactly the same.
Real-Life Example
Example 1: A magistrate in Lucknow issues a conditional order to Rakesh to remove an obstruction from a public road within 3 days. Rakesh does nothing and does not appear in court. Under Section 136, Rakesh is liable to penalty under Section 188 IPC, and the order is made absolute. The magistrate can now force removal of the obstruction.
Example 2: A magistrate in Delhi issues a conditional order to Sanjay to repair a dangerous building. Sanjay ignores the order and does not appear in court. The magistrate makes the order absolute and Sanjay is liable to penalty under Section 188 IPC. The magistrate can now have the building repaired at Sanjay's expense.
Example 3: A magistrate in Mumbai issues a conditional order to Priya to fence an unfenced well. Priya does not comply and does not appear. The order is made absolute. Priya can be prosecuted under Section 188 IPC for disobedience.
Example 4: A magistrate in Bengaluru issues a conditional order to Vikas to stop a harmful trade. Vikas appears in court but does not perform the act. The magistrate hears his arguments. If the arguments are not accepted, the order is made absolute. Vikas is not liable to the penalty because he appeared, but he must stop the trade.
Example 5: A magistrate in Patna issues a conditional order to Gopal to remove a nuisance. Gopal performs the act but does it after the specified time. He does not appear in court. The magistrate may still make the order absolute and Gopal may face penalty for the delay.
Example 6: A magistrate in Jaipur issues a conditional order to Meena. Meena appears in court and shows cause. The magistrate accepts her cause and cancels the order. Section 136 does not apply because Meena appeared and showed cause.
Example 7: A magistrate in Chennai issues a conditional order to Arjun. Arjun neither complies nor appears. The order is made absolute. Arjun is prosecuted under Section 188 IPC and fined ₹500. He is also ordered to pay the cost of removing the nuisance.
Example 8: A magistrate in Hyderabad issues a conditional order to Sohan. Sohan ignores the order. The magistrate makes the order absolute and refers the matter for prosecution under Section 223 BNS. Sohan is convicted and sentenced to simple imprisonment for 15 days.
