146. (1) On proof of a change in the circumstances of any person, receiving, under section 144 a monthly allowance for the maintenance or interim maintenance, or ordered under the same section to pay a monthly allowance for the maintenance, or interim maintenance, to his wife, child, father or mother, as the case may be, the Magistrate may make such alteration, as he thinks fit, in the allowance for the maintenance or the interim maintenance, as the case may be. (2) Where it appears to the Magistrate that, in consequence of any decision of a competent Civil Court, any order made under section 144 should be cancelled or varied, he shall cancel the order or, as the case may be, vary the same accordingly. (3) Where any order has been made under section 144 in favour of a woman who has been divorced by, or has obtained a divorce from, her husband, the Magistrate shall, if he is satisfied that— (a) the woman has, after the date of such divorce, remarried, cancel such order as from the date of her remarriage; (b) the woman has been divorced by her husband and that she has received, whether before or after the date of the said order, the whole of the sum which, under any customary or personal law applicable to the parties, was payable on such divorce, cancel such order,- (i) in the case where such sum was paid before such order, from the date on which such order was made; (ii) in any other case, from the date of expiry of the period, if any, for which maintenance has been actually paid by the husband to the woman; (c) the woman has obtained a divorce from her husband and that she had voluntarily surrendered her rights to maintenance or interim maintenance, as the case may be, after her divorce, cancel the order from the date thereof. (4) At the time of making any decree for the recovery of any maintenance or dowry by any person, to whom a monthly allowance for the maintenance and interim maintenance or any of them has been ordered to be paid under section 144, the Civil Court shall take into account the sum which has been paid to, or recovered by, such person as monthly allowance for the maintenance and interim maintenance or any of them, as the case may be, in pursuance of the said order.

What is this section about?

This section deals with the modification of maintenance orders after they have been passed. Life circumstances change, and the maintenance amount that was appropriate at the time of the order may become too high or too low later. This section allows the Magistrate to increase, decrease, or even cancel the maintenance order based on changes in circumstances. It also covers situations where a civil court decision affects the maintenance order.

When can the Magistrate alter the maintenance?

Sub-section (1) allows alteration on proof of a "change in circumstances" of either party. This could include: the person paying maintenance losing their job or getting a promotion; the person receiving maintenance getting a job; the child growing up and no longer needing support; the parents' health improving or worsening; or any other significant change. The Magistrate has discretion to decide what alteration is appropriate.

What is the effect of a civil court decision?

Sub-section (2) deals with civil court decisions. If a competent civil court makes a decision that affects the maintenance order - for example, a decree of divorce or a property settlement - the Magistrate must cancel or vary the maintenance order accordingly. The Magistrate has no discretion here - they must follow the civil court's decision.

What about divorced women?

Sub-section (3) has special rules for divorced women. If a divorced woman remarries, the maintenance order is cancelled from the date of remarriage. If she receives a lump sum payment on divorce (under customary or personal law), the maintenance order is cancelled from the date of the order if the payment was made before the order, or from the date the maintenance period expires if payment was made later. If she voluntarily surrenders her right to maintenance, the order is cancelled from that date.

What is the difference between old and new law?

The substance is identical. The only difference is the section references: the old CrPC Section 127 refers to Section 125, while the new BNSS Section 146 refers to Section 144. The provisions for alteration on change of circumstances, civil court decisions, and divorce-related cancellations remain exactly the same.

Real-Life Example

Example 1: A man in Lucknow named Rakesh was ordered to pay ₹15,000 per month maintenance to his wife. Rakesh loses his job and his income drops to zero. He applies to the Magistrate under Section 127(1) for a reduction. The Magistrate reduces the maintenance to ₹5,000 per month due to the change in circumstances.

Example 2: A woman in Delhi named Sunita receives ₹10,000 per month maintenance from her husband. She gets a well-paying job and no longer needs the maintenance. Her husband applies for a reduction. The Magistrate, on proof of the change in circumstances, reduces the maintenance to ₹2,000 per month.

Example 3: A civil court in Mumbai grants a decree of divorce to Priya's husband. The civil court also orders a property settlement. Under Section 127(2), the Magistrate cancels the maintenance order because the civil court's decision makes the maintenance order unnecessary.

Example 4: A woman in Bengaluru named Meena was receiving maintenance from her ex-husband after divorce. She remarries. Under Section 127(3)(a), the Magistrate cancels the maintenance order from the date of her remarriage. She is no longer entitled to maintenance.

Example 5: A woman in Patna named Gauri received a lump sum payment of ₹5 lakh on divorce under personal law. The maintenance order was passed after she received the payment. Under Section 127(3)(b)(i), the Magistrate cancels the maintenance order from the date of the order.

Example 6: A woman in Jaipur named Anita voluntarily surrenders her right to maintenance after divorce. She files a declaration to that effect. Under Section 127(3)(c), the Magistrate cancels the maintenance order from the date of her surrender.

Example 7: A man in Chennai named Arjun gets a promotion and his income increases significantly. His wife applies for an increase in maintenance. The Magistrate, on proof of the change in circumstances, increases the maintenance from ₹10,000 to ₹20,000 per month.

Example 8: A woman in Hyderabad named Kavya was receiving interim maintenance during the pendency of her maintenance case. The final maintenance order is passed. The Magistrate adjusts the interim maintenance paid against the final order under Section 127(4).
