143. (1) When a person for whose appearance a summons or warrant has been issued under the proviso to sub-section (3) of section 140 or under sub-section (10) of section 142, appears or is brought before the Magistrate or Court, the Magistrate or Court shall cancel the bond or bail bond executed by such person and shall order such person to give, for the unexpired portion of the term of such bond, fresh security of the same description as the original security. (2) Every such order shall, for the purposes of sections 139 to 142 (both inclusive) be deemed to be an order made under section 125 or section 136, as the case may be.

What is this section about?

This section deals with what happens when a surety wants to cancel their bond, or when a magistrate rejects a surety under Section 140 (BNSS) / 121 (CrPC). In both cases, the court may issue a summons or warrant to bring the person (for whom the surety was bound) before the court. Once that person appears, the court cancels the old bond and orders fresh security for the remaining (unexpired) period of the original bond.

When does this apply?

This section applies in two situations. First, under the proviso to Section 140(3) (BNSS) / 121(3) (CrPC), when a magistrate rejects a surety who was previously accepted, the court summons the accused person to appear before it. Second, under Section 142(10) (BNSS) / 123(10) (CrPC), when a surety applies to cancel the bond, the court issues a summons or warrant for the person to appear. In both cases, once the person appears, this section applies.

What happens when the person appears?

The court must cancel the existing bond. The person is no longer bound by that bond. However, the court then orders the person to give fresh security. The fresh security must be of the same description as the original security - meaning the same type of bond (peace or good behaviour), and the amount and number of sureties may be similar. The fresh security is only for the unexpired portion of the original bond term, not for the full period.

What is the effect of sub-section (2)?

Sub-section (2) is a deeming provision. It says that for the purposes of the provisions relating to bonds (Sections 139-142 in BNSS / 120-123 in CrPC), any order under this section is treated as if it were an order made under Section 125 (CrPC 106) or Section 136 (CrPC 117). This means that all the rules about giving security - including the consequences of failing to give security - apply to this new security order just as they apply to the original orders.

What is the difference between old and new law?

The substance is nearly identical. The main differences are: (1) The section references have been updated (Section 121 to 140, Section 123 to 142, Section 106 to 125, Section 117 to 136, Sections 120-123 to 139-142). (2) The new BNSS uses the term "bond or bail bond" instead of just "bond" in sub-section (1). The procedure for cancelling the old bond and ordering fresh security remains exactly the same.

Real-Life Example

Example 1: A magistrate in Lucknow previously accepted Rakesh's brother as a surety. Later, the magistrate rejects the brother as unfit under Section 121(3). The court issues a summons to Rakesh. Rakesh appears in court. Under Section 124(1), the court cancels the original bond and orders Rakesh to give fresh security for the remaining 4 months of the original bond period.

Example 2: A surety named Sanjay in Delhi applies to cancel his bond under Section 123(10). The court issues a warrant and brings the accused, Priya, before it. Under Section 124(1), the court cancels Sanjay's bond and orders Priya to give fresh security for the unexpired portion of the bond period.

Example 3: A magistrate in Mumbai rejects a previously accepted surety. The court issues a summons to the accused, Vikas. Vikas appears. The court cancels the bond and orders Vikas to provide fresh security of the same amount and with the same number of sureties for the remaining 6 months.

Example 4: A surety in Bengaluru applies to cancel his bond. The court summons the person for whom the surety was bound. The person appears. Under Section 124, the court cancels the bond and orders the person to provide fresh security. The court deems this order as if it were made under Section 117, so all the rules about default apply.

Example 5: A magistrate in Patna rejects a surety. The accused, Gopal, is brought before the court. The court cancels the bond and orders Gopal to give fresh security for the unexpired period. Gopal fails to give the fresh security. Under sub-section (2), this is treated as a failure to give security under Section 117, and Gopal can be imprisoned under Section 122.

Example 6: A surety in Jaipur cancels his bond. The court brings the accused, Meena, before it. The court cancels the bond and orders Meena to give fresh security. Meena provides the fresh security and is released. The original surety is now free from his obligation.

Example 7: A magistrate in Chennai rejects a surety who was previously accepted. The court issues a warrant for the accused, Arjun, who is in another city. Arjun is brought before the court. The court cancels the bond and orders fresh security. The new security is for the same period as the remaining portion of the original bond.

Example 8: A surety in Hyderabad applies to cancel his bond. The court issues a summons to Sohan. Sohan appears. The court cancels the bond and orders fresh security. Under sub-section (2), this order is deemed to be an order under Section 136. All provisions of Sections 139 to 142 apply to this new order.
