136. If, upon such inquiry, it is proved that it is necessary for keeping the peace or maintaining good behaviour, as the case may be, that the person in respect of whom the inquiry is made should execute a bond, with or without sureties, the Magistrate shall make an order accordingly: Provided that— (a) no person shall be ordered to give security of a nature different from, or of an amount larger than, or for a period longer than, that specified in the order made under section 130; (b) the amount of every bond shall be fixed with due regard to the circumstances of the case and shall not be excessive; (c) when the person in respect of whom the inquiry is made is a child, the bond shall be executed only by his sureties.

What is this section about?
This section is the final step in the security proceedings. After the magistrate has conducted an inquiry under Section 135 (CrPC 116) and heard the evidence, they must decide whether the person should be ordered to give security. If the magistrate finds that it is necessary to keep the peace or maintain good behaviour, they must make a final order requiring the person to execute a bond. The bond can be with or without sureties, depending on the circumstances.
What are the limitations on the order?
The proviso (the "provided that" clauses) imposes three important limitations. First, the security ordered cannot be different in nature, larger in amount, or longer in period than what was specified in the original show cause order under Section 130 (CrPC 111). This protects the person from the magistrate imposing harsher terms than what they were originally warned about. Second, the amount of the bond must be fixed with due regard to the circumstances and cannot be excessive. The magistrate must be reasonable. Third, if the person is a minor (child), the bond must be executed only by the sureties, not by the minor themselves.
What happens after the order is made?
Once the order is made, the person must execute the bond. If they fail to do so, they can be imprisoned under Section 141 (BNSS) / Section 122 (CrPC). The bond period begins either immediately or after any existing sentence of imprisonment is completed. The bond binds the person to keep the peace or be of good behaviour.
What is the difference between old and new law?
The substance is nearly identical. The main differences are: (1) The section references have been updated (Section 111 to 130). (2) The old CrPC used the term "minor," while the new BNSS uses the term "child." Both refer to a person under the age of majority, but the term "child" is more modern and aligns with other child protection laws. The meaning is the same. (3) The new BNSS also uses "bond" and "bail bond" in other related sections, but here it retains "bond." The three limitations on the order remain exactly the same.
Real-Life Example
Example 1: A magistrate in Lucknow conducts an inquiry against Rakesh. After hearing the evidence, the magistrate finds that Rakesh is likely to cause a breach of peace. The magistrate makes a final order under Section 117 requiring Rakesh to execute a bond of ₹10,000 with one surety to keep the peace for 6 months. This is the same amount and period as specified in the original order under Section 111.
Example 2: A magistrate in Delhi conducts an inquiry against Sanjay. The original order under Section 111 specified a bond of ₹15,000 with two sureties for 1 year. During the inquiry, the magistrate finds that a lower amount would be sufficient. Under Section 117, the magistrate orders a bond of ₹10,000 with one surety for 6 months. This is allowed because the proviso only prevents increasing the amount, not decreasing it.
Example 3: A magistrate in Mumbai conducts an inquiry against Priya. Priya is a minor (under 18). The magistrate finds that a bond is necessary. Under Section 117(c), the magistrate orders that the bond be executed only by Priya's sureties, not by Priya herself. This protects Priya from personal liability.
Example 4: A magistrate in Bengaluru conducts an inquiry against Vikas. The magistrate finds that Vikas needs to execute a bond. However, the magistrate orders a bond of ₹50,000, which is much higher than the ₹10,000 specified in the original order. This violates proviso (a). Vikas can challenge the order as illegal.
Example 5: A magistrate in Patna conducts an inquiry against Gopal. The original order specified a bond for 2 years. After the inquiry, the magistrate orders a bond for 3 years. This violates proviso (a) because it is longer than the original order. Gopal can appeal the order.
Example 6: A magistrate in Jaipur conducts an inquiry against Meena. The magistrate orders Meena to execute a bond of ₹20,000. Meena argues that this is excessive given her income. The magistrate reviews the circumstances and reduces the bond to ₹10,000. This is allowed because the amount must not be excessive.
Example 7: A magistrate in Chennai conducts an inquiry against Arjun. The magistrate orders Arjun to execute a bond. Arjun provides the bond with sureties. The bond is accepted, and Arjun is released. If Arjun breaches the peace during the bond period, the bond will be forfeited.
Example 8: A magistrate in Hyderabad conducts an inquiry against Sohan. Sohan is a child (under 18). The magistrate orders Sohan's parents to act as sureties and execute the bond on his behalf. The bond is executed by the sureties, not by Sohan. This complies with Section 136(c).

आदेश दिए जाने के बाद क्या होता है?
