Explained in Simple English & Hindi with Real-Life Examples

Bond or bail bond for good behaviour for a period not exceeding one year.

Original Text

128. When an Executive Magistrate receives information that there is within his local jurisdiction a person taking precautions to conceal his presence and that there is reason to believe that he is doing so with a view to committing a cognizable offence, the Magistrate may, in the manner hereinafter provided, require such person to show cause why he should not be ordered to execute a bond or bail bond for his good behaviour for such period, not exceeding one year, as the Magistrate thinks fit.

In Simple Words (English)

What is this section about?

This section is a preventive measure aimed at people who are hiding or sneaking around with bad intentions. If an Executive Magistrate receives information that someone is taking precautions to conceal their presence - meaning they are hiding, using false names, avoiding being seen - and there is reason to believe they are doing this to commit a crime, the magistrate can take action. The magistrate can require that person to explain why they should not be ordered to execute a bond for good behaviour.

What does "taking precautions to conceal his presence" mean?

This phrase covers a wide range of suspicious behaviour. Examples include: someone staying in a place using a fake name, someone who avoids being seen by neighbours, someone who changes their appearance frequently, or someone who moves from place to place to avoid being tracked. The key is that the person is deliberately hiding themselves in a way that suggests they are planning something illegal.

What is the connection to committing a cognizable offence?

The magistrate must have reason to believe that the person is hiding with a view to committing a cognizable offence. A cognizable offence is one where the police can arrest without a warrant - serious offences like theft, robbery, murder, or cheating. The hiding behaviour must be connected to a likely future crime, not just a general suspicion.

What is the maximum period for the bond?

The bond can be ordered for a period not exceeding one year. This is the same as Sections 126 and 127. The magistrate has discretion to decide the exact period based on the circumstances.

What is the difference between old and new law?

The substance is identical. The main differences are: (1) The new BNSS uses the term "bail bond" alongside "bond" to provide more flexibility. (2) The section numbers of related sections have changed. The procedure, the one-year maximum period, and the requirement that the person must be hiding with intent to commit a cognizable offence remain exactly the same.

Real-Life Example

Example 1: The police in Lucknow receive a tip that a known criminal, Ramesh, is staying in a hotel using a fake name. He is not registered at the hotel and avoids being seen. The police report this to the Executive Magistrate. The Magistrate, believing Ramesh is hiding to commit a robbery, issues a show cause notice under Section 109. Ramesh fails to appear, and the Magistrate orders him to execute a bond for good behaviour for 1 year.

Example 2: A person named Sanjay in Delhi is seen moving from place to place, changing his appearance frequently. The police suspect he is planning a theft. The Executive Magistrate issues a show cause notice. Sanjay appears and explains he is a salesman who travels for work. The Magistrate holds an inquiry and finds the explanation plausible. He discharges Sanjay.

Example 3: In Mumbai, the police find a person living in a rented room with no identification. He has no job and is seen meeting with known criminals. The Executive Magistrate issues a show cause notice under Section 109. The person refuses to give his real name. The Magistrate orders him to execute a bond of ₹10,000 with one surety for good behaviour for 6 months.

Example 4: The police in Bengaluru inform the Magistrate that a history-sheeter, Vikas, has been seen in the city but is avoiding police contact. The Magistrate issues a show cause notice. Vikas appears and denies hiding. The Magistrate holds an inquiry, finds evidence that Vikas was indeed hiding, and orders him to execute a bond for good behaviour for 1 year.

Example 5: A person in Chennai is found living in a slum using a false name. He has no visible means of income. The police suspect he is hiding to commit a chain snatching. The Executive Magistrate issues a show cause notice. The person does not appear. The Magistrate proceeds ex parte and orders him to execute a bond with sureties for good behaviour for 1 year.

Example 6: In Patna, the police receive information that a person who is a suspect in a murder case is hiding in a village. The Executive Magistrate issues a show cause notice under Section 109. The person appears and provides a valid alibi. The Magistrate holds an inquiry and finds that the person was not hiding to commit an offence. He discharges the person.

Example 7: A person in Jaipur is found staying in a lodge without any luggage or identification. He is seen making phone calls late at night. The police suspect he is planning a robbery. The Magistrate issues a show cause notice. The person appears and explains he is a private investigator. The Magistrate holds an inquiry, checks his credentials, and discharges him.

Example 8: In Hyderabad, the police find a person hiding in an abandoned building. He has a criminal record. The Magistrate issues a show cause notice under Section 109. The person does not appear. The Magistrate orders him to execute a bond for good behaviour for 1 year. When the person is later caught committing a theft, the bond is forfeited.
