127. (1) When an Executive Magistrate receives information that there is within his local jurisdiction any person who, within or without such jurisdiction,— (i) either orally or in writing or in any other manner, intentionally disseminates or attempts to disseminate or abets the dissemination of,- (a) any matter the publication of which is punishable under section 152 or section 196 or section 197 or section 299 of the Bharatiya Nyaya Sanhita, 2023; or (b) any matter concerning a Judge acting or purporting to act in the discharge of his official duties which amounts to criminal intimidation or defamation under the Bharatiya Nyaya Sanhita, 2023; (ii) makes, produces, publishes or keeps for sale, imports, exports, conveys, sells, lets to hire, distributes, publicly exhibits or in any other manner puts into circulation any obscene matter such as is referred to in section 294 of the Bharatiya Nyaya Sanhita, 2023, and the Magistrate is of opinion that there is sufficient ground for proceeding, the Magistrate may, in the manner hereinafter provided, require such person to show cause why he should not be ordered to execute a bond or bail bond, for his good behaviour for such period, not exceeding one year, as the Magistrate thinks fit. (2) No proceedings shall be taken under this section against the editor, proprietor, printer or publisher of any publication registered under, and edited, printed and published in conformity with, the rules laid down in the Press and Registration of Books Act, 1867 with reference to any matter contained in such publication except by the order or under the authority of the State Government or some officer empowered by the State Government in this behalf.

What is this section about?

This section gives magistrates the power to demand security (a bond) from people who spread harmful content. The focus is on two types of harmful content: seditious or hateful material (that promotes enmity between groups or insults religious beliefs), and obscene material. If a magistrate receives information that someone is disseminating such content, they can require that person to show cause why they should not be ordered to execute a bond for good behaviour.

What content is covered?

Under the old law, the seditious content covered material punishable under IPC sections 124A (sedition), 153A (promoting enmity between groups), 153B (imputations prejudicial to national integration), and 295A (deliberate insult to religious beliefs). Under the new law, these correspond to BNS sections 152, 196, 197, and 299 respectively. The section also covers obscene matter as referred to in section 292 of IPC (now section 294 of BNS). Additionally, it covers any matter concerning a Judge that amounts to criminal intimidation or defamation.

What is the maximum period for the bond?

The bond can be ordered for a period not exceeding one year. This is the same as Section 126 (peace bond without conviction), and shorter than the three-year maximum under Section 125 (peace bond after conviction).

What is the protection for legitimate publications?

Sub-section (2) provides an important protection for the press. No proceedings can be taken under this section against the editor, proprietor, printer, or publisher of a publication that is registered under the Press and Registration of Books Act and is edited, printed, and published according to its rules. Such proceedings can only be initiated by order or authority of the State Government or an officer empowered by the State Government. This protects freedom of the press from frivolous action by individual magistrates.

What is the difference between old and new law?

The substance is nearly identical. The main differences are: (1) The IPC sections (124A, 153A, 153B, 295A, 292) have been replaced by their BNS equivalents (152, 196, 197, 299, 294). (2) The new BNSS uses the term "bail bond" alongside "bond" to provide more flexibility. (3) The section title in BNSS is slightly different, referring to "certain matters" instead of "seditious matters." The procedure, the one-year maximum period, and the protection for registered publications remain exactly the same.

Real-Life Example

Example 1: A person in Lucknow has been distributing pamphlets that promote enmity between religious groups. The police report this to the Executive Magistrate. The Magistrate issues a show cause notice under Section 108 to the person. After an inquiry, the Magistrate finds that the pamphlets contain material punishable under Section 153A IPC. He orders the person to execute a bond of ₹10,000 with one surety for good behaviour for 6 months.

Example 2: A publisher in Delhi prints a book containing obscene pictures under Section 292 IPC. The State Government receives complaints and authorizes the District Magistrate to take action. The Magistrate issues a show cause notice to the publisher under Section 108. The publisher appears and argues that the book is not obscene. The Magistrate holds an inquiry and finds the book obscene. He orders the publisher to execute a bond for good behaviour for 1 year.

Example 3: A person in Mumbai is caught selling obscene DVDs. The police report to the Magistrate. The Magistrate issues a show cause notice under Section 108. The person does not appear. The Magistrate proceeds ex parte and orders him to execute a bond of ₹15,000 with two sureties for good behaviour for 1 year.

Example 4: A newspaper in Bengaluru publishes an article insulting a Judge. The Judge's official duties are mentioned, and the article amounts to defamation. The State Government authorizes action under Section 108. The Magistrate issues a show cause notice to the editor. The editor appears and argues that the article was factual. The Magistrate holds an inquiry and finds the article defamatory. He orders the editor to execute a bond for good behaviour for 6 months.

Example 5: A person in Chennai is spreading hate speech against a particular community. The Magistrate receives information and issues a show cause notice under Section 108. The person appears and denies the allegations. The Magistrate holds an inquiry, takes evidence, and finds the person guilty. He orders the person to execute a bond with sureties for good behaviour for 1 year.

Example 6: A publisher in Patna prints a book that insults a religious figure. The State Government does not authorize action. The Magistrate cannot proceed against the publisher under Section 108 because sub-section (2) requires State Government authorization for registered publications. The publisher is protected.

Example 7: A person in Jaipur is caught distributing seditious material. The Magistrate issues a show cause notice under Section 108. The person appears and shows cause that he was only distributing the material on behalf of a political party. The Magistrate holds an inquiry and finds the material indeed contains seditious content. He orders the person to execute a bond for good behaviour for 3 months.

Example 8: A magazine in Hyderabad publishes obscene content. The State Government authorizes the District Magistrate to proceed under Section 108. The Magistrate issues a show cause notice to the printer. The printer argues that he only printed what was given to him. The Magistrate holds an inquiry and finds the printer was not aware of the content. He discharges the printer but takes action against the publisher.
