126. (1) When an Executive Magistrate receives information that any person is likely to commit a breach of the peace or disturb the public tranquillity or to do any wrongful act that may probably occasion a breach of the peace or disturb the public tranquillity and is of opinion that there is sufficient ground for proceeding, he may, in the manner hereinafter provided, require such person to show cause why he should not be ordered to execute a bond or bail bond for keeping the peace for such period, not exceeding one year, as the Magistrate thinks fit. (2) Proceedings under this section may be taken before any Executive Magistrate when either the place where the breach of the peace or disturbance is apprehended is within his local jurisdiction or there is within such jurisdiction a person who is likely to commit a breach of the peace or disturb the public tranquillity or to do any wrongful act as aforesaid beyond such jurisdiction.

What is this section about?

This section is a preventive tool for magistrates to stop trouble before it starts. Unlike Section 125 (which deals with peace bonds after a conviction), Section 126 operates BEFORE any crime is committed. If a magistrate receives information that someone is likely to cause a breach of the peace or disturb public tranquillity, they can take preventive action. This is like a court saying, "We think you might cause trouble, so we want you to promise to behave or face consequences."

How does the process work?

The magistrate must first receive information about the person's likely behaviour. This information could come from a police report, a complaint, or any other reliable source. The magistrate must then form an opinion that there is sufficient ground to proceed. Once they are satisfied, they require the person to "show cause" - which means the person must explain why they should not be ordered to execute a bond to keep the peace.

What is a "show cause" notice?

The "show cause" notice is an opportunity for the person to defend themselves. They can come to court and say, "I am not likely to cause trouble" or "The information against me is false." The magistrate will then hold an inquiry (as provided in later sections) to decide whether the bond is necessary. The person has a chance to present their side before any order is made.

What is the maximum period for the bond?

The bond can be ordered for a period not exceeding one year. This is shorter than the three-year maximum under Section 125 (which applies after conviction). The magistrate has discretion to decide the exact period based on the circumstances.

What about jurisdiction?

The magistrate can take action if either the place where the trouble is expected is within their area, OR if the person who is likely to cause trouble is within their area (even if the trouble would happen elsewhere). This gives magistrates flexibility to act.

Key differences between old and new law:

The substance is nearly identical. The main differences are: (1) The new BNSS uses the term "bail bond" alongside "bond" to provide more flexibility. (2) The section numbers of related sections have changed. The procedure, the show cause notice, the one-year maximum period, and the jurisdictional rules remain exactly the same.

Real-Life Example

Example 1: The Patna police receive information that a local goon, Rakesh, is threatening shopkeepers and likely to cause a breach of the peace. The Sub-divisional Magistrate, on receiving this information, issues a show cause notice to Rakesh under Section 107. Rakesh appears and argues that he was just settling disputes peacefully. The magistrate holds an inquiry and finds no sufficient ground. He discharges Rakesh without ordering a bond.

Example 2: A landlord in Delhi, Mr. Sharma, repeatedly threatens to evict tenants using violence. The tenants file a complaint. The District Magistrate issues a show cause notice under Section 107 to Mr. Sharma. After an inquiry, the magistrate finds that Mr. Sharma is likely to cause trouble. He orders Mr. Sharma to execute a bond of ₹20,000 with one surety to keep the peace for 6 months.

Example 3: Two rival political groups in Lucknow are planning rallies on the same day. The police inform the Executive Magistrate that there is a high risk of a breach of peace. The Magistrate issues a show cause notice to the leaders of both groups under Section 107. After hearing them, the Magistrate orders both leaders to execute bonds to keep the peace during the rally period.

Example 4: A person named Sanjay in Mumbai has a history of getting into fights during festivals. The police report this to the Magistrate. The Magistrate issues a show cause notice. Sanjay appears and promises to behave. The Magistrate, satisfied that Sanjay will keep the peace, discharges him without ordering a bond.

Example 5: A woman in Bengaluru, Meera, has been involved in multiple public arguments with her neighbour. The neighbour files a complaint. The Magistrate issues a show cause notice to Meera. She does not appear. The Magistrate proceeds ex parte and orders her to execute a bond to keep the peace for 1 year.

Example 6: A factory owner in Jaipur, Gopal, has been using goons to intimidate workers. The workers complain to the police. The Sub-divisional Magistrate issues a show cause notice under Section 107. Gopal denies the allegations. The magistrate holds an inquiry, takes evidence, and finds Gopal likely to breach peace. He orders Gopal to execute a bond of ₹50,000 with two sureties for 6 months.

Example 7: A person in Chennai, Arjun, is known to provoke communal tensions. The police submit a report to the Executive Magistrate. The Magistrate issues a show cause notice. Arjun appears and presents evidence that the report is false. The Magistrate holds an inquiry and finds the police report unreliable. He discharges Arjun.

Example 8: In Hyderabad, a history-sheeter named Vikas is released from prison. The police believe he will resume his criminal activities. They inform the Magistrate under Section 107. The Magistrate issues a show cause notice. Vikas does not appear within the given time. The Magistrate orders him to execute a bond to keep the peace for 1 year. When Vikas is later arrested for a new offence, the bond is forfeited.
