BHARATIYA NAGARIK SURAKSHA SANHITA (BNSS)
Section 11 BNSS — Special Judicial Magistrates
Explained in Simple English & Hindi with Real-Life Examples
Original Text
11. Special Judicial Magistrates. (1) The High Court may, if requested by the Central or State Government so to do, confer upon any person who holds or has held any post under the Government, all or any of the powers conferred or conferrable by or under this Sanhita on a Judicial Magistrate of the first class or of the second class, in respect to particular cases or to particular classes of cases, in any local area: Provided that no such power shall be conferred on a person unless he possesses such qualification or experience in relation to legal affairs as the High Court may, by rules, specify. (2) Such Magistrates shall be called Special Judicial Magistrates and shall be appointed for such term, not exceeding one year at a time, as the High Court may, by general or special order, direct.
In Simple Words (English)
This section allows the High Court to appoint Special Judicial Magistrates. The Central Government or State Government can make a request to the High Court for such appointments. The High Court then gives the powers of a Judicial Magistrate (first or second class) to a person who currently holds or has previously held a government post.
These special magistrates are not given full, unlimited powers. The High Court can give them all powers or only some powers. Also, these powers are limited to particular cases or particular classes of cases, and to a specific local area. For example, a Special Judicial Magistrate may only handle traffic violation cases in one district.
The person being appointed as a Special Judicial Magistrate must have the right qualifications or experience in legal matters. The High Court makes rules about what qualifications are needed. This ensures that even though the person may not be a regular judge, they still have enough legal knowledge to do the job properly.
These Special Judicial Magistrates are appointed for a fixed term. The term cannot be longer than one year at a time. The High Court can renew the appointment after the term ends. This is a temporary arrangement to handle specific needs, like clearing a backlog of cases or dealing with a sudden increase in certain types of crimes. In BNSS, the provision about empowering Special Judicial Magistrates to work in metropolitan areas has been removed, making the section simpler.
