Section 16 of the General Clauses Act, 1897 provides that where a power to make an appointment is conferred, the appointing authority shall also have the power to suspend or dismiss any person so appointed, unless a different intention appears. Therefore, the Visitor, being the appointing authority for the first Registrar under the transitional provision, also possesses the power to terminate his services. However, transitional provisions have a temporary operation and become spent once the initial appointments are made. The regular Registrar would be appointed by the Executive Council under Section 14 of the Act, and disciplinary action against such regular Registrar would be governed by Statute No. 28, where the Executive Council is the appointing authority.

The Rajiv Gandhi National Aviation University was established under the Rajiv Gandhi National Aviation University Act, 2013. The Visitor granted approval for termination on 20.04.2022, and the termination was communicated on 27.04.2022. The First Registrar challenged the termination before the High Court. The learned Single Judge held that the First Registrar was entitled only to one month's salary as he had not been confirmed beyond probation. The Division Bench allowed the appeal, holding that the Visitor had no role in disciplinary proceedings and quashed the termination order. The University and the Union of India appealed to the Supreme Court.
